What is the DMCA?

- Do not financially benefit directly from the infringing activity
- Act expeditiously to remove infringing material upon receiving proper notice

How to Submit a Takedown Notice

Required Information in Your Notice
To be valid under 17 U.S.C. § 512(c)(3), your DMCA takedown notice must include all of the following:
A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
A description of the copyrighted work you claim has been infringed. If multiple works are covered, a representative list is acceptable.
The exact URL(s) on our Site where the infringing content is located, so we can identify and remove it.
Your full name, mailing address, telephone number, and email address so we can reach you.
A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
A statement that the information in the notification is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on their behalf.

Our Review Process
Once we receive a valid DMCA notice, our process is as follows:
- Acknowledgment: We will acknowledge receipt of your notice within 3–5 business days
- Review: Our team reviews the notice for completeness and validity
- Removal: If the notice is valid, we will remove or disable access to the identified content within 48 hours of validation
- Notification: We will notify the uploader (if applicable) that their content has been removed
- Record: We maintain records of all DMCA notices received
We reserve the right to reject notices that are incomplete, fraudulent, or submitted in bad faith.
Filing a Counter-Notice
If you believe that content was removed from our Site as a result of a mistaken or misidentified DMCA notice, you may file a counter-notice. Under 17 U.S.C. § 512(g)(3), a valid counter-notice must include:
- Your physical or electronic signature
- Identification of the content that was removed and its location before removal
- A statement under penalty of perjury that you have a good-faith belief the content was removed due to mistake or misidentification
- Your name, address, telephone number, and email address
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or (if outside the U.S.) any judicial district in which we may be found
- A statement that you will accept service of process from the person who submitted the original DMCA notice

Repeat Infringer Policy
In accordance with the DMCA and our commitment to respecting intellectual property, PomPom Hub maintains a strict repeat infringer policy.
Users or content contributors who are found to be repeat infringers — meaning they have had content removed multiple times due to valid copyright complaints — will have their access to our platform permanently terminated.
We define a repeat infringer as any person who has received more than two valid DMCA takedown notices in any rolling 12-month period. All repeat infringer actions are logged and final.
False DMCA Claims
⚠️ Warning: Submitting a false or fraudulent DMCA notice is a serious legal matter. Under 17 U.S.C. § 512(f), any person who knowingly and materially misrepresents that content is infringing may be liable for damages, including court costs and attorneys' fees, incurred by the alleged infringer, the content owner, or the service provider.
We take abuse of the DMCA process seriously. Notices submitted in bad faith — including those targeting content that is clearly non-infringing, licensed, or fair use — will be rejected and may be referred to legal counsel.
